The firm's real estate practice reaches diverse aspects of the real estate industry and encompasses both transactional and litigation matters. We represent commercial and industrial landlords and tenants, commercial, industrial, and residential real estate brokers, real estate partnerships, institutional lenders, developers, property managers and mobilehome park developers and operators. The scope of this representation includes purchase and sale agreements, 1031 exchange agreements, security agreements, financing agreements, property management agreements, and a wide variety of less common real estate contracts. We also provide advice concerning environmental issues and have experience in defending CERCLA and RCRA actions brought by governmental entities and private persons seeking contribution.

Jones Bell's real estate litigation practice encompasses the defense and prosecution of actions involving the respective obligations of buyers and sellers, commercial and industrial landlords and tenants, and property managers. We regularly deal with issues of disclosure, possession, title, operating expense, build-out, construction, fixtures, title insurance, escrows, holdover tenancies, unlawful detainer, fair value, broker liability, nuisance, and securitization, as well as a wide variety of associated contractual, statutory and insurance coverage issues.
